Court threatens to commit GOC to prison
Court in Ibadan has threatened to commit the General Officer Commanding, 2 Mechanised Division, Nigerian Army, Ibadan, Major-General Muhammed Abubakar, to prison for contempt if he fails to appear in Court on October 30.
The order was given by Justice Adejumo Obaseki, yesterday during the sitting of the Court over a suit filed by Alhaji G.O Fagbohun against the GOC.
The 2 Division and the Olukola Oganla family have been involved in a land dispute which the family claimed the Army forcefully took from them.
The GOC had been accused of refusing to release the land as ordered by the Court in an earlier judgment by the same Court in 2005.
Part of the land measuring 8.572 hectares was alleged to have been set aside as old shooting range by the army at Letmauck Barracks in Ibadan.
Mr. Abiodun Amole, counsel to the plaintiff had argued that since nobody is above the law, it amounted to outright insult on the Court for the GOC to behave the way he did.
In his defence, counsel to the Nigerian Army, Temil A. A, said his client enjoys immunity and the judge disagreed and proved him wrong constitutionally.
